Intellectual Property Rights (IPR) are various exclusive rights for a certain period
- Right to exclusive use
- Right to prevent others
- Right to assign (sharing rights)/license (permission to use)
granted by the Government to a creator.
Similar to land with a strong fence, when you register your IPR, you own what is inside.
It protects human creatively and primarily to stimulate innovation, design, and creation of new technology. It provides the industry and innovators the incentive and means to finance research and development activities. It also ensure fair competition.
Trademark
Trade Mark means a mark capable of being represented graphically and which is capable of distinguishing the goods or services of one person from those of others.
Copyright
Copyright protects expression of an idea, rather than the idea. No requirement as to artistic value or merits but should be original work. It covers Literary, dramatic & musical work, Artistic work.
Patents
A Patent is a statutory right for an invention granted for a limited period of time (20 years) to the patentee by the Government, in exchange of full disclosure of his/her invention.
Industrial Design
An Industrial Design is the ornamental or aesthetic aspect of a useful article, which must appeal to the sense of sight and may consist of the shape and/or pattern and/or color of article.
Geographical Indication
It is an indication. It originates from a definite geographical territory. It is used to identify agricultural, natural or manufactured goods. GI is a right in public domain
